Our discussions will now move to the realm of corrections. Considering the ethical systems reviewed in the course to this point, apply those concepts to these aspects of the correctional system:

  • Defend or reject the use of capital punishment with one or more of the ethical theories discussed so far in this course.
  • Describe the three ethical frameworks for punishment: utilitarianism, deontology, and peacemaking. Which one do you think should serve as the ethical framework for punishment today? Why?
  • Ethical principles are not as clear-cut for probation officers as they are for police officers. A probation officer must serve as both a mentor to the clients as well as a law enforcer. Discuss the ethical systems that guide the work of a probation officer and describe how they may present the officer with difficulties on the job.

In this final week, we will apply the concepts reviewed in this course to the law enforcement function. For this week’s discussion, consider the following questions, with the ethical systems in mind.

  • Is it ethical for detectives to deliberately use deception during an interrogation? The Supreme Court has ruled that deceptions are legal, but are they ethical? If so, identify under which ethical system police would be permitted to use deception as an interrogation technique.
  • All police agencies make use of informants. Larger departments even pay their informants and keep track of their contributions to cases. Discuss the ethical problems of using informants to assist with investigations.
  • You have read about a concept known as “accepted lies” in police work. Give an example of an “accepted lie” and show how it is ethically permissible.

Managing an ethical police department can be a difficult challenge. As you have seen, the criminal justice field often presents situations that would appear to be governed by competing ethical systems. The very nature of police work presents officers with ethical challenges not found in other occupations.

For this assignment, you have been contracted to assist an urban police department improve its ethical performance. Your task is to provide police leadership with background and guidance on the following topics. Prepare a report in Microsoft Word that addresses each of these points:

  • Describe how organizations can become corrupt, using Trautman’s “corruption continuum” as a guide. 
  • Explain the “continuum of compromise” as it relates to individual police misconduct, including how it might help supervisors recognize warning signs. Include the concept of “means–end” thinking in your review.
  • Describe Bandura’s definition of self-regulation and describe how aspects of the law enforcement job can cause one to turn away from self-regulation.
  • Last, considering that police agencies are nearly evenly-split on the topic of gratuities, determine whether you would recommend a policy that forbids patrol officers from accepting gratuities. Support your position with reasoning and research.
