For this assignment, read the cases of Miller v. Alabama and Jackson v. Hobbs (2012). These cases deal with the topic of juveniles tried and sentenced as adults.

  1. Analyze whether either of these cases addresses the utilitarian view of ethical treatment of convicted murderers.
  2. Differentiate between the peacemaking philosophy and deontological philosophy in the context of murder sentencing for juveniles. Do these philosophies differ when the defendant is an adult?
  3. Considering these two cases, determine whether either should have been handled differently under the utilitarian or the deontological philosophies.
  4. In general terms, consider a judge who must determine whether a 16-year-old who committed a violent crime should be tried as an adult. Identify the ethical dilemma(s) the judge faces and describe how he or she might arrive at an ethical decision.

You are the chief legal officer (CLO) of a Fortune 500 company (this should be a company that you create, not a real company) for the next five weeks. The board of directors approved the international launch of a new wireless laptop. As the CLO, you will be working on the legal aspects of the product launch. The top-secret name for the project is Operation Competitor.

For Part 1 of Operation Competitor, your team will start the research necessary for the laptop’s product launch. You will begin an analysis report about your competitors in the marketplace.

Assignment Details

Choose a real international company that manufactures laptops of which you feel will be competition. Your analysis report should include the following;

  • Inspect current policies and procedures concerning the liability of your chosen competitor.
  • Determine if your competitor has (within the last 5 years) faced any liability in tort and criminal penalties.
  • Examine your chosen competitor’s (if applicable) copyright, patent, trademark, and trade secrets and then discuss the importance of these areas for businesses during these processes.

Deliverable Requirements

Your analysis report should be at least 5 pages in length. Be sure to cite sources using APA properly; include references and in-text citations. The Title page and Reference page do not count as part of the 5 pages.

Submitting your assignment in APA format means, at a minimum, you will need the following:

Title page: Remember the running head. The title should be in all capitals.

Length: 5 pages minimum

Body: This begins on the page following the title page and must be double-spaced (be careful not to triple- or quadruple-space between paragraphs). The typeface should be 12-pt. Times Roman or 12-pt. Courier in regular black type. Do not use color, bold type, or italics, except as required for APA-level headings and references. The deliverable length of the body of your paper for this assignment is 5 pages. In-body academic citations to support your decisions and analysis are required. A variety of academic sources is encouraged.

Reference page: References that align with your in-body academic sources are listed on the final page of your paper. The references must be in APA format using appropriate spacing, hanging indent, italics, and uppercase and lowercase usage as appropriate for the type of resource used. Remember, the Reference page is not a bibliography but a further listing of the abbreviated in-body citations used in the paper. Every referenced item must have a corresponding in-body citation.
